Starting January 21, 2025, Canada will overhaul its Family Open Work Permit (FWOP) program, introducing stricter eligibility criteria for spouses of international students and foreign workers. The changes aim to better align temporary resident programs with the country’s economic priorities and address labor shortages in key sectors. Here are 10 key things you need to know about the new rules:
1) Revised Eligibility for Spouses of Internation
3) Work Permit Duration for Foreign Workers
The principal foreign worker must have at least 16 months remaining on their work permit at the time their spouse applies for an OWP.
4) Exclusion of Dependent Children
Dependent children of foreign workers will no longer be eligible for Family OWPs under the updated criteria.
5) Impact on Current Work Permits
Family OWPs issued under the previous rules will remain valid until their expiration date. Renewal applications will need to meet the new criteria.

A detailed list of eligible occupations for Family OWPs will be published by the government on January 21, 2025.
8) Exemptions for Specific Groups
Spouses of workers under free trade agreements and those transitioning to permanent residency will not be affected by the new restrictions.
9) Flexibility for Ineligible Family Members
Family members who no longer qualify for a Family OWP can explore other work permit options available under Canada’s broader programs.
10) Program Goals
These changes are intended to improve the integrity of Canada’s temporary resident programs, ensuring they align more effectively with economic goals and labor market priorities.
Only spouses of students enrolled in select programs—such as master’s programs lasting 16 months or longer, doctoral programs, and certain professional programs—will qualify for Family OWPs.
